Constructive dismissal

Constructive dismissal

Constructive dismissal, in simple terms can be defined when an employee's position has become untenable or they feel they are being forced out of a job. This may often result in you being given a newly assigned position, which could involve a reduction in salary, bonus, benefits, responsibilities and authority, which are all factors of constructive dismissal.

Constructive dismissal can be very upsetting and certainly life altering so if you have been subject to any of the changes mentioned above you may be able to sue for constructive dismissal.

Constructive dismissal can, however, only be claimed if you have left the premises, then a settlement can either be worked out or proceedings can commence.

If there have been fundamental changes in your position at work that included a reduction in salary, change in responsibilities and benefits or even forced resignation, then talk to Turner Coulston and we will be happy to advise whether you have a case for constructive dismissal.
